E-Gift Cards Terms and Conditions

1. General Provisions

These Terms and Conditions govern the purchase and use of e-Gift Cards within the online store www.easy-surfshop.com. Their purpose is to ensure clear, secure, and fair rules for all participants in transactions involving e-Gift Cards.

These regulations apply exclusively to consumers as defined by applicable Polish law. Any terms written in capital letters but not defined in these regulations have the meaning assigned to them in the General Terms and Conditions, unless stated otherwise. If terms are defined both in these regulations and in the Online Store’s general terms, the definitions in these regulations take precedence.

2. Definitions

• E-Gift Card / Card – A digital discount voucher recorded in a non-material form, sold by the Online Store, granting the bearer a discount of a specified value when making a purchase. The e-Gift Card is not a financial instrument or a bank-issued payment card. It serves as an identification voucher under Article 92115 of the Polish Civil Code.
• Discount Code – A unique alphanumeric sequence assigned to an e-Gift Card, which, when entered at checkout, grants a one-time discount equal to the Card’s value.
• Purchaser – A natural person who is a consumer as defined in Article 221 of the Polish Civil Code and who purchases an e-Gift Card in the Online Store.
• User – The Purchaser or any bearer who is a consumer and uses the e-Gift Card for purchases in the Online Store.
• Issuer – EASY-surfshop, operated under the business name EASY SURF Bartosz Grzesiek, located at ul. Św. Michała 100, 61-005 Poznań, Poland, registered in the Central Register and Information on Economic Activity (CEIDG), with NIP: 7821239556 and REGON: 631147690.

3. Purchase of e-Gift Cards

• e-Gift Cards can only be purchased and used by consumers.
• The Issuer offers e-Gift Cards in fixed denominations: €25, €50, €100, €250, €500, and €1000.
• e-Gift Cards cannot be exchanged for cash, either in full or in part.
• e-Gift Card values do not accrue interest and cannot be increased once issued.
• Payment for e-Gift Cards must be made using the available payment methods in the Online Store.
• e-Gift Cards cannot be used to purchase other e-Gift Cards.
• Discount codes cannot be applied when purchasing e-Gift Cards.
• e-Gift Cards are delivered electronically in PDF format to the Purchaser’s email address.
• No physical version of the e-Gift Card is available.
• e-Gift Cards are sent during business hours. Purchases made outside business hours will be processed on the next business day.
• e-Gift Cards cannot be returned. By purchasing an e-Gift Card, the Purchaser waives the right of withdrawal in accordance with Article 38 of the Polish Consumer Rights Act.

4. Using the e-Gift Card

• e-Gift Cards can only be used once within their 12-month (365 days) validity period from the date of issuance.
• If the total order value exceeds the e-Gift Card’s balance, the User must pay the difference using another available payment method.
• If the total order value is lower than the e-Gift Card’s balance, the remaining amount is forfeited—partial redemptions or refunds for unused funds are not possible.
• e-Gift Cards can only be used for online purchases at www.easy-surfshop.com and are not valid in the physical store.
• The Issuer is not responsible for lost or stolen e-Gift Cards, nor for cases where an incorrect email address was provided by the Purchaser.
• The Issuer reserves the right to temporarily suspend e-Gift Card payments due to technical issues but will restore functionality as soon as possible.

5. Returns & Refunds for Orders Paid with e-Gift Cards

• If an order paid with an e-Gift Card is returned, the refund will be credited back to the same e-Gift Card.
• If an order was partially paid with an e-Gift Card and another payment method, refunds will be processed accordingly.
• e-Gift Cards cannot be refunded or converted to cash under any circumstances.

6. Complaints & Dispute Resolution

• Complaints regarding e-Gift Cards can be submitted via email to contact@easy-surfshop.com or in writing to: EASY-surfshop, ul. Św. Michała 100, 61-005 Poznań, Poland.
• The Issuer will review complaints within 14 days of receipt.
• If a complaint is not resolved in the User’s favor, they may pursue alternative dispute resolution through the Online Dispute Resolution (ODR) platform at https://ec.europa.eu/consumers/odr/.

7. Personal Data Protection

• Personal data provided by the Purchaser is processed by the Issuer in accordance with applicable data protection laws.
• Providing personal data is voluntary but necessary for purchasing and fulfilling an e-Gift Card.
• Detailed information on data processing is available in the Privacy Policy.

8. Amendments to the Regulations

The Issuer reserves the right to modify these Terms and Conditions in cases of:

• Changes in legal regulations.
• Technological developments affecting service provision.
• Introduction of new features or modifications to existing ones.

Changes take effect immediately upon publication on www.easy-surfshop.com and do not affect previously issued e-Gift Cards.

9. Final Provisions

• Matters not regulated in these Terms and Conditions are subject to Polish law.
• The choice of Polish law does not deprive consumers of protections granted under mandatory legal provisions in their country of residence.
